What is Mass 201 CMR 17?

In an effort to protect Massachusetts residents from the rising incidence of fraud and identity theft from data loss, the State of Massachusetts has implemented aggressive regulatory requirements to protect personal information. The state now requires mandatory compliance with 201 CMR 17.00 – Standards for the Protection of Personal Information of Residents of the Commonwealth (also known as just 201 CMR 17, or the Massachusetts Privacy Law). Massachusetts Privacy Law establishes a minimum standard to be met for the protection of Massachusetts resident’s personal information contained in both paper and electronic records. For the purpose of being compliant with the new Massachusetts data privacy law, PI is defined as a resident’s first name and last name or first initial and last name in combination with any one or more of the following data elements that relate to the resident:

1. Social Security number;
2. driver’s license number or Massachusetts identification card number;
3. financial account number, or credit or debit card number, with or without any required security code, access code, personal identification number or password that would per-mit access to a resident’s financial account; or
4. a biometric indicator.

The Massachusetts data privacy law has set a new level in state security laws by regulating both private and public sector entities that handle Massachusetts resident’s sensitive data, regardless of where that entity is located. The law is intended to bring entities into alignment with both federal and industry security laws, including the Safeguards Rule under the Gramm-Leach-Bliley Act (GLBA) enforced by the Federal Trade Commission (FTC) and Payment Card Industry Data Security Standards (PCI-DSS) security standards overseen by the PCI Security Standards Council. Its process and technical controls are aimed at preventing criminal activity from causing data breaches of either paper or electronic records containing PI. The requirement of securing electronic records includes PI on databases, laptops, applications, portable devices, and just about any other system in which electronic PI data can be either in transit or at rest.

Does Mass 201 CMR 17 Apply to me?

All persons, corporations, associations, partnerships or other legal entities with systems containing Massachusetts resident’s personal information in transit or at rest are responsible for complying with the 201 CMR 17 regulations by March 1, 2010. However, the regulations also require businesses to complete internal and external security risk assessments prior to the effective date. The regulation applies regardless of whether the entities or the data is either inside or outside state borders, and applies equally to private and public sector organizations.

What If I do not comply?

The penalties for non-compliance with 201 CMR 17 are enforced through Massachusetts General Law Title XV: Regulation of Trade, chapter 93A, section 4. Violators may be faced with a civil penalty of $5,000 for each violation, are required to pay the reasonable costs of investigation and litigation of such violation (including reasonable attorney’s fees), and are subject to additional civil action since 201 CMR 17 creates a baseline standard that allows plaintiffs in civil suits to argue that a business that lost data was negligent. Title XV also requires any data breach be reported to both the Office of Consumer Affairs and Business Regulation (OCABR) and the Attorney General.

The new Massachusetts Privacy Law requires the following criteria be met:

1. An internal and external risk assessment of the human, physical, technical environment based on the criteria outlined in 201 CMR 17
2. The computer security provisions in the regulation use a risk-based approach that comply to the extent that it is technically feasible, meaning that reasonable means must be used to accomplish a required result if there is a reasonable technology is available
3. The results of the internal and external risk assessments must be documented in a Written Comprehensive Information Security Program (WISP)
4. The scope of the WISP must be reviewed at least on an annual basis or whenever there is a change in business practices that may impact security controls

The OCABR published the 201 CMR 17 Compliance Checklist as an aid to be used by either organizations themselves or their auditors when conducting their risk assessment. However, additional guidance on how and where to submit risk assessment results is expected from the state prior to the March 2010 deadline.

HIPAA Privacy Rules

Under the HIPAA Privacy and Security Rules, covered entities are obliged to observe proper methods of disposing protected health information (PHI), of any form. Appropriate measures of disposal are required to prevent and limit any unauthorized use and access to the information. Furthermore, covered entities handling electronic PHI are required to impose policies and procedures to facilitate the removal, termination and final disposal of PHI in electronic format including the storage media housing the information.

Though there is no standard method of disposing PHI supplied under the HIPAA Law, covered entities are prohibited from discarding old PHI in open places, or abandoning it in containers accessible to the public or to any unauthorized individual.

Covered entities may evaluate their own measures for document destruction, and revise these procedures if necessary, to maintain and ensure the privacy of their patient’s information all the way through final disposal. Assessment on the weight of the information to be disposed should also be conducted to determine if the actions undertaken are sufficient for the purpose. Sensitive information such as name, SSN, and driver’s license number, among others, may be dealt with extra prudence and security considering the degree of risk involved once the information is exposed.

Covered entities may acquire the assistance of other businesses such as paper shredding and document shredding to perform the disposal on its behalf. However, both the covered entity and business partner must enter into an agreement demonstrating the proper handling and disposal of the information. The terms of the contract may indicate the protocols to be followed while transporting the PHI from the premises of the covered entity to its final destination. Appropriate methods of Document Shredding Disposal may include, but should not limit to the following:
PHI in paper can be shredded, pulverized or burned so as to make whatever information present on the sheet unusable.

Handing over PHI and other labeled prescription bottles administered to patients to business partners authorized to destroy and dispose the items.

For PHI made in electronic format, content of the media can be shredded or overwritten through the use of software applications or hardware components designed to destroy information. Storage devices used to contain PHI may also be destroyed. Covered entities may be required to perform other methods of disposal depending upon the demand of the information that needs to be eradicated. Additionally, covered entities are strongly recommended to apply the procedures followed by other medical institutions and practitioners concerning the disposal of PHI. It should also be noted that, covered entities may allow its patients to collect from its premises their PHI considering that some states require specified durations before information are applicable for disposal.

The retention period of a document is an aspect of records management. It represents the period of time a document should be kept or “retained”. At the termination of the retention period, the document is usually destroyed. The term is generally used by accountants and tax professionals whose occupation involves dealing with legal documents that only need to remain in existence for a certain amount of time. The retention period varies for different types of records. For example, business incorporation documents have a permanent retention period (meaning that they should be retained and never be destroyed), but receipts for tax-deductible purchases by an individual taxpayer usually have a three-year retention period (and can often be safely discarded after that point.) The length of the retention period is based on the likelihood that the document will be needed at some point in the future. Records that will serve no further purpose (as determined by the length of their retention period) are destroyed for space issues, usually by paper shredders. Retention requirements are also established for a variety of electronic records in industry-specific legislation (such as the Sarbanes-Oxley Act) and regulatory bodies (such as the Federal Energy Regulatory Commission) in the United States.
